Acceptance of Terms
By downloading, installing, accessing, or using the NexTutor application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App.
These Terms constitute a legally binding agreement between you ("User", "Student", or "you") and NexTutor ("we", "us", or "our"). If the User is under 18 years of age, a parent or legal guardian must review and accept these Terms on their behalf.

Description of Service
NexTutor is an AI-powered educational tutoring application designed for Sri Lankan students. The App provides:
- AI-generated lessons aligned with the Sri Lankan O/L (Ordinary Level) curriculum for Mathematics and Science
- Support for Grades 6 through 11
- Trilingual content delivery in English, Sinhala (සිංහල), and Tamil (தமிழ்)
- AI voice tutoring (text-to-speech narration)
- AI-generated assessments with 20 questions per lesson
- AI-powered remediation chat for personalized feedback
- Progress tracking, XP points, and learning streaks
All educational content, lessons, questions, and feedback are dynamically generated by Google Gemini AI and are not pre-authored by human educators.

User Accounts & Eligibility
To use NexTutor, you must authenticate via Microsoft Entra ID (Azure Active Directory). By signing in, you represent that:
- You are a student in Grades 6–11 in Sri Lanka, or a parent/guardian registering on behalf of such a student
- The information you provide during registration is accurate and complete
- You are responsible for maintaining the confidentiality of your account credentials
- You will notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Subscription & Payments
NexTutor operates on a freemium subscription model:

- Free Trial: 3 free lessons with full features
- Subscription: LKR 1,500 per subject per month
- Each subscription is valid for exactly 4 weeks (28 days) from the date of payment
- Your subscription grants access to 4 subject topics which may be selected at any time during the active period
- Subscriptions do not auto-renew; you must manually renew after the 4-week period expires
- Payment is processed securely through our designated payment provider

Refund Policy
⚠️ Important: Please Read Carefully
Because NexTutor provides immediate access to a digital library of AI-generated Maths and Science content for Grades 6–11, our refund policy is as follows:
5.1 Subscription Period
Every subscription is valid for exactly 4 weeks (28 days) from the date of payment.
5.2 Topic Access
Your subscription allows access to 4 subject topics. These topics can be selected at any time during your active 4-week period.
5.3 Expiration
Any unused topic selections or uncompleted lessons expire automatically at the end of the 4-week period. We do not provide refunds or "rollover" credits for topics that were not selected or lessons that were not completed during the active subscription window.
5.4 Technical Issues
Refunds are only considered if a verifiable technical fault on our platform prevents you from accessing your selected topic for more than 48 continuous hours. To request a refund for technical issues:
- Contact our support team with your Order ID
- Submit the request within your active subscription period
- Provide details of the technical issue encountered
5.5 Change of Mind
We do not offer refunds for "change of mind" or if the student decides not to use the App after the subscription has started. Once payment is confirmed and access is granted, the purchase is considered final.

AI-Generated Content Disclaimer
🤖 AI Disclosure
All educational content within NexTutor — including lessons, slides, questions, answers, voice narration scripts, chat responses, and remediation feedback — is dynamically generated by artificial intelligence (Google Gemini AI). No content is pre-written or reviewed by human educators prior to delivery.
By using NexTutor, you acknowledge and agree that:
- You are interacting with an AI system, not a human tutor
- AI-generated content is provided on an "as-is" basis
- The AI may produce content that is inaccurate, incomplete, outdated, or contextually inappropriate
- NexTutor is a supplementary learning tool and should not replace formal classroom instruction, textbooks, or guidance from qualified teachers
- AI-generated assessments and scores are indicative and should not be treated as official academic evaluations

Accuracy & Limitations of AI
While we strive to deliver high-quality educational content, AI technology has inherent limitations:
- Hallucinations: AI models may generate plausible-sounding but factually incorrect information (known as "hallucinations"). Users should cross-verify critical information with official textbooks or teachers
- Bias: AI-generated content may reflect biases present in training data. We do not guarantee that content is free from all forms of bias
- Curriculum Alignment: While lessons are structured around the Sri Lankan O/L syllabus, the AI may occasionally include or omit topics. NexTutor does not guarantee complete syllabus coverage
- Language Quality: Content generated in Sinhala and Tamil may contain grammatical or translational inconsistencies due to the nature of multilingual AI generation
- Mathematical Accuracy: While the AI is prompted for mathematical precision, errors in calculations, formula representations, or problem-solving steps may occur
We strongly recommend that students and parents treat NexTutor as a supplementary revision and practice tool, not as a sole source of educational truth.

User Responsibility for AI Output
Users bear responsibility for how they use AI-generated content from NexTutor:
- Review & Validate: Users should review, validate, and exercise their own judgment before relying on any AI-generated content for academic purposes
- No Professional Substitute: NexTutor content does not constitute professional educational, medical, psychological, or any other form of professional advice
- Academic Integrity: Users must not submit AI-generated content from NexTutor as their own original work in school assignments, examinations, or any academic assessments
- Parental Oversight: Parents and guardians are encouraged to monitor their child's use of the App and review AI-generated content where appropriate

Data, Privacy & AI Training
9.1 Data We Collect
- Account information (name, email, grade, subject preferences) via Microsoft Entra ID authentication
- Lesson history and progress data (topics studied, scores, XP, streaks)
- Chat interactions with the AI tutor
- Voice input data (when using speech recognition features)
9.2 How We Use Your Data
- To provide and personalize the NexTutor educational experience
- To track learning progress and generate performance analytics
- To improve the quality and accuracy of our AI prompts and service
9.3 AI Training Disclosure
📊 Transparency Notice
NexTutor sends your lesson requests and chat messages to the Google Gemini API for content generation. These interactions are subject to Google's AI Terms of Service. We do not independently use your personal data to train AI models. However, aggregate, anonymized usage patterns may be analyzed to improve our prompt engineering and content quality.
9.4 Data Security
We implement industry-standard security measures, including encrypted API communications (HTTPS), Azure-managed authentication, and secure key management via Azure Key Vault. However, no system is 100% secure, and we cannot guarantee absolute security of your data.
9.5 Children's Privacy
NexTutor is designed for students aged approximately 11–17. We do not knowingly collect personal information from children under 11 without verifiable parental consent. If we discover that we have collected data from a child under 11 without appropriate consent, we will delete such information promptly.

Prohibited Uses
You agree not to use NexTutor for any of the following:
- Attempting to "jailbreak", manipulate, or circumvent safety controls, content filters, or platform guardrails via prompt engineering or injection techniques
- Using the AI chat features to generate content unrelated to the educational curriculum (e.g., harmful, violent, sexual, or illegal content)
- Reverse engineering, decompiling, or attempting to extract the source code, AI prompts, or proprietary logic of the App
- Sharing your subscription credentials with others or allowing unauthorized access to your account
- Scraping, bulk-downloading, or systematically extracting AI-generated content for redistribution or commercial purposes
- Using the App in any manner that could damage, disable, overburden, or impair our servers or infrastructure
- Misrepresenting AI-generated content as human-authored educational material
Violation of these prohibited uses may result in immediate account suspension or termination without refund.

Intellectual Property
- The NexTutor brand, logo, application design, UI/UX, and underlying code are the intellectual property of NexTutor and are protected by applicable copyright and trademark laws
- AI-generated educational content delivered through the App is licensed to you for personal, non-commercial, educational use only during your active subscription period
- You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content or materials from the App without prior written permission
- The Sri Lankan O/L curriculum structure and syllabus framework referenced by NexTutor remain the property of the Ministry of Education, Sri Lanka

Limitation of Liability
⚠️ Disclaimer of Warranties
NexTutor is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by applicable law:
- We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement
- We do not warrant that AI-generated content will be accurate, complete, current, error-free, or suitable for achieving specific academic outcomes
- We are not liable for any academic performance outcomes, examination results, or educational consequences arising from the use of or reliance on NexTutor content
- Our total liability for any claims arising under these Terms shall not exceed the amount you paid to NexTutor in the 12 months preceding the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, academic opportunities, or goodwill

Indemnification
You agree to indemnify, defend, and hold harmless NexTutor, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your reliance on AI-generated content for purposes beyond supplementary education
- Any third-party claims related to content you generate, share, or distribute using the App

Modifications to Terms
We reserve the right to modify, update, or replace these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. The "Last Updated" date at the top of this page will reflect the most recent revision.
Continued use of NexTutor after changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically, especially given the rapidly evolving nature of AI technology and its regulatory landscape.

Termination
We may terminate or suspend your access to NexTutor at any time, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Abuse of AI features or prohibited use violations
- Fraudulent payment or subscription activity
- Extended inactivity (account dormancy)
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and intellectual property rights) shall remain in effect.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
